Alton man charged with taping underage girl

ALTON — An Alton man was arraigned in Laconia District Court Monday on charges of videotaping an underage girl he had asked to perform a sex act.
Judge Lawrence MacLeod, Jr. ordered 41-year-old Frank Toland of Spruce Terrace held on $100,000 cash bail after hearing the charges against him, including claims by local police that he attempted to flee from his apartment when confronted, and assaulted the officers involved in his arrest.
According to an affidavit filed with the court, the Alton Police Department received a referral last week from the Portsmouth District Office of the state's Division of Children, Youth and Families (DCYF) alerting them to allegations of sexual abuse made by a local minor who admitted to sleeping in the same bed with an older man she identified as Toland.
Lt. Richard Vanderhoof and Officer Jason Tremblay were sent to Toland's apartment at Spruce Terrace at around 9:22 p.m. on March 26 to check on the status of the minor who filed the report.
According to the affidavit, Toland came to the door when the two officers knocked, and confirmed that a young female was also there when asked whether anyone else was in the apartment with him.
When the two officers asked him if they could speak with the young girl, Toland stepped back into the apartment. A few moments later, the girl (who identified herself as the minor who had filed the allegations of abuse) came to the door, reportedly barefoot and dressed in a pair of shorts and a T-shirt.
After being ushered away from the apartment by Vanderhoof, the minor admitted under questioning that there had been "inappropriate activity" going on, but refused to go into detail.
When he was informed by Vanderhoof that the officers planned to detain him for further questioning, Toland denied any inappropriate contact with the girl.
Vanderhoof ordered Toland to stay with Tremblay, and walked back over to the girl to gather further information. As he and the girl continued to talk, according to the affidavit, Toland said "I'm out of here!" and fled.
Both officers gave chase and ran down Toland, who allegedly punched Tremblay in the chest and elbowed Vanderhoof before they could restrain him with handcuffs.
Armed with a search warrant, police searched Toland's apartment the following day (March 27) and found three cell phones in his bedroom, one of which allegedly contained a 37-second video file (created just moments before Vanderhoof and Tremblay's arrival) depicting the young girl engaged in a sexual act.
Toland, who stands charged with felonious sexual assault, child pornography, resisting arrest or detention and simple assault, is currently being held at the Belknap County House of Corrections, and is slated to appear in court for a probable cause hearing on April 6.
According to the affidavit, he has an extensive criminal history dating back to 1987, including 12 felony convictions.
